The Department has construed "niche" to not require placement of cremains in an urn or additional container.  In response to an inquiry several years ago regarding a columbarium constructed of prefabricated, modular niches, Department counsel concluded that a space may constitute a "niche" even though it may hold cremated remains without the need for an additional container.
